Frankel & Newfield Secures Victory on Discovery, Met Life Reinstates Claim
Issue:
In litigation of an ERISA case, we were seeking depositions of claim handling personnel and discovery of attorney-client documents, as well as agreements with the paper reviewing doctors.
Result:
The Court granted our requests for discovery, compelling Met Life to provide documents they were seeking to withhold, and shortly thereafter, made a decision to reinstate our client and pay all back benefits and attorneys fees.
Frankel & Newfield Hits CIGNA hard, Forces Reinstatement of Claim
Issue:
Our client was compelled to pursue litigation after exhausting her administrative remedies in her ERISA disability claim. We brought suit against CIGNA and her employer seeking all of her employee benefits.
Result:
In litigation, we secured an Order from the Court requiring CIGNA to produce witnesses for deposition, including the biased doctor who altered his opinions at the urging of CIGNA. Shortly thereafter, CIGNA agreed to reinstate the claim, and pay interest and attorneys' fees.

Issue:
Our client, an attorney, had her claim terminated by Sun Life, on the basis of a limited pay period for mental conditions, despite the presence of her chronic pain.
Result:
Early in litigation, Sun Life agreed to pay her claim for past benefits and even acknowledged that her benefit amount was incorrectly calculated. She is now back on claim with her increased benefit payment.

Issue:
Our client's individual disability claim was terminated by UNUM Provident, after it determined that the insured, an attorney, was disbarred from practicing law. We needed to demonstrate that he was disabled from practicing law as a result of his disabling condition (an addiction), rather than from the loss of his law license.
Result:
We negotiated a favorable resolution of the claim which secured the client significant money under the policy.

Issue:
Our client's claim was wrongfully denied by Met Life, who refused to recognize that the client suffered from fibromyalgia. We litigated the issue in Federal Court.
Result:
During litigation, we negotiated a resolution that placed the client back on claim to continue to pursue further benefits.

Issue:
Our client's claim was wrongfully terminated by Liberty Life, who determined that he no longer qualified for benefits under the policy. We litigated the issue of his continued disability in Federal Court.
Result:

Issue:
Our client's disability claim was rejected by Paul Revere, who wrongfully decided that he could continue to be a commodities broker even after severe heart problems.
Result:
We litigated this case to a successful resolution, settling the matter prior to trial for $450,000.00.

Issue:
UNUM refused to recognize our client's total disability claim, choosing to pay him under the residual disability clause and shortening his benefit pay period from lifetime to age 65, resulting in a significant loss of benefits.
Result:
We litigated this case to a successful resolution, settling the matter prior to trial for $515,000.00.
