Frankel & Newfield Secures Victory on Discovery, Met Life Reinstates Claim
Issue:
In litigation of an ERISA case, we were seeking depositions of claim handling personnel and discovery of attorney-client documents, as well as agreements with the paper reviewing doctors.
Result:
The Court granted our requests for discovery, compelling Met Life to provide documents they were seeking to withhold, and shortly thereafter, made a decision to reinstate our client and pay all back benefits and attorneys fees.
Frankel & Newfield Hits CIGNA hard, Forces Reinstatement of Claim
Issue:
Our client was compelled to pursue litigation after exhausting her administrative remedies in her ERISA disability claim. We brought suit against CIGNA and her employer seeking all of her employee benefits.
Result:
In litigation, we secured an Order from the Court requiring CIGNA to produce witnesses for deposition, including the biased doctor who altered his opinions at the urging of CIGNA. Shortly thereafter, CIGNA agreed to reinstate the claim, and pay interest and attorneys' fees.

Our client, an attorney, had her claim terminated by Sun Life, on the basis of a limited pay period for mental conditions, despite the presence of her chronic pain.

Our client's disability claim was rejected by Paul Revere, who wrongfully decided that he could continue to be a commodities broker even after severe heart problems.
